Notice of Privacy Practices

This notice describes how health information about you may be used and disclosed, how you can get access to this information, and your rights. Please review it carefully.

Privacy contact: Brandi Hess, MA, LMFT · (385) 501-2907 · brandi.intentional.living@gmail.com

Your Rights

You may ask to inspect or obtain a copy of certain health information; ask to correct or amend information you believe is incorrect or incomplete; request confidential communications by a particular method or at a particular location; ask us to limit certain uses or disclosures; obtain an accounting of certain disclosures; receive a paper or electronic copy of this notice; and file a privacy complaint without retaliation. These rights are subject to applicable legal limitations, procedures, and timelines.

If you pay in full out of pocket for a service and ask us not to disclose information about that service to your health plan for payment or healthcare operations, we will honor the restriction when required by law.

A legally authorized personal representative may exercise applicable privacy rights on your behalf, subject to law.

Our Responsibilities

Intentional Living is required by law to maintain the privacy and security of protected health information, provide this notice, follow the privacy practices described in the current notice, and notify affected individuals when required if a breach compromises unsecured protected health information.

How We May Use or Share Information

We may use or disclose protected health information for treatment, payment, and healthcare operations and for other purposes permitted or required by law. Examples may include care coordination, billing and insurance activities, quality and practice operations, public-health activities, health oversight, certain judicial or administrative proceedings, certain law-enforcement purposes, workers' compensation, preventing or reducing a serious threat to health or safety when legally permitted, reporting abuse/neglect/exploitation when required or permitted, organ/tissue donation, medical examiner/coroner functions, research when legally authorized, and other uses or disclosures required by law.

When a family member, friend, caregiver, or other person is involved in your care or payment, limited relevant information may be shared when permitted by law and appropriate under the circumstances. Being a payer, emergency contact, relative, or partner does not create unrestricted access to your information.

Uses Requiring Authorization

Uses or disclosures not otherwise permitted by law generally require your written authorization. Authorization is generally required for most uses of HIPAA-defined psychotherapy notes, certain marketing, sale of protected health information, and other uses when required by law. You may revoke an authorization in writing, subject to actions already taken in reliance on it and other legal limits. Treatment will not be conditioned on an optional authorization except where law permits.

Psychotherapy Notes

HIPAA-defined psychotherapy notes, if separately maintained, receive additional protections. They are different from ordinary progress notes and other parts of the clinical record. Not every therapist maintains separate psychotherapy notes.

Substance Use Disorder Information

Certain substance use disorder patient records are subject to additional federal protections under 42 CFR Part 2 and related law. When Intentional Living creates, receives, or maintains records subject to those protections, the records will be handled according to applicable requirements. Qualifying Part 2 records generally may not be used in civil, criminal, administrative, or legislative proceedings against a patient based on the content of those records without the consent or court process required by law.

Electronic Communications, Portal & Reminders

Intentional Living may use electronic systems for scheduling, billing, forms, reminders, secure messaging, and telehealth. Secure portal communication is encouraged for sensitive information. Standard email and text messaging carry privacy risks. Appointment reminders and administrative messages will be limited to reasonably necessary information, and you may request reasonable alternative communication methods.

Marketing, Public Content & Client Information

Intentional Living does not treat participation in therapy as permission to use your identity, image, testimonial, treatment experience, or identifiable clinical information for marketing, social media, educational content, podcasts, or other public use. Identifiable information will be used publicly only with lawful authorization when required. General clinical knowledge and properly de-identified or composite material may be used when legally and ethically appropriate.

Breach Notification

Intentional Living will investigate privacy/security incidents and notify affected individuals and others when required by applicable breach-notification law.

Complaints

You may contact Brandi Hess, MA, LMFT at (385) 501-2907 or brandi.intentional.living@gmail.com with privacy questions or complaints. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Intentional Living will not retaliate against you for exercising privacy rights or filing a complaint.

Intentional Living may change this notice as permitted by law. A revised notice may apply to information already maintained as well as future information. The current notice will be available upon request and on the practice website.
